Gifts in Wills

There are many ways of including a Gift in your Will and we recommend that you seek independent financial and legal advice when writing your Will or adding a Codicil to your Will. Below is some suggested wording you may consider with your legal advisor when you are preparing or updating your Will.

 

Gifting the residue of your estate

A residuary gift refers to what remains of your estate after all expenses have been paid, specific gifts have been distributed and all claims on the Estate have been settled. A residuary gift may be a percentage or the whole of what is left of your Estate. 

I give, free of all duties and taxes, [x% or all] of the residue of my estate to The Spinal Research Institute Limited (ABN 11 162 207 169), or successor organisation, of Royal Talbot Rehabilitation Centre, 1 Yarra Blvd, Kew 3101 for its general purposes. I declare that the receipt of this bequest by any authorised officer of The Spinal Research Institute Limited or successor organisation shall form valid discharge to my Executor(s).

A pecuniary gift

A pecuniary bequest is a gift of a fixed dollar amount determined at the time of making or changing your Will.

I give, free of all duties and taxes, the sum of [$x] to The Spinal Research Institute Limited (ABN 11 162 207 169), or successor organisation, of Royal Talbot Rehabilitation Centre, 1 Yarra Blvd, Kew 3101 for its general purposes. I declare that the receipt of this bequest by any authorised officer of The Spinal Research Institute Limited or successor organisation shall form valid discharge to my Executor(s).

A specific gift

You may also choose to gift a specific item of property. If you would like to give a specific asset, which could have capital gains tax benefits, please contact us.
